The driver in a fatal DUI crash earlier this year as well as the bar and bartender that allegedly served him alcohol has been sued by the mother of the victim. According to the Cook County lawsuit, on January 19, Matthew Talavera, 23, was out drinking at Joe E’s Unforgettable Lounge in Chicago. Afterward, Talavera was driving with Richard Smart, 24, in the passenger seat when he allegedly crashed into a parked car. Smart was ejected from the front seat and died from the injuries he sustained in the crash. Talavera was charged with DUI, driving without insurance, negligent driving and a lane usage violation. His BAC was allegedly over three times the legal limit at .270.
The Cook County lawsuit names Talavera, the bar, and the alleged bartender as defendants and seeks an unspecified amount of damages.
