Because aggravated speeding is a criminal charge, you should expect to attend court. At the first court date, your attorney files an appearance and begins discussing the case with the prosecutor.
When a resolution is reached, it is presented to the judge for approval. If the case cannot be resolved fairly, it can be set for trial.
Our focus is the best possible result for your situation. In one case that means a reduction to a non criminal charge; in another it means supervision; and in some cases it means taking the State’s evidence to trial. Depending on your facts, we work toward:
Cases at Round Lake Beach may be prosecuted by a village attorney or by the Lake County State’s Attorney’s Office, depending on the agency that wrote the ticket, and that can shape how negotiations unfold.
Convictions for moving violations are reported to the Illinois Secretary of State, and three within 12 months can lead to a suspension. Drivers under 21 face stricter rules. If you already have a suspended or revoked license, we also handle Illinois driver’s license reinstatement.
Supervision allows a case to end without a conviction. The court sets a period and conditions, usually fines, costs and no new violations, and the charge is dismissed when you complete them. It is not allowed for aggravated speeding in a school zone or construction zone, and your driving history can affect eligibility.
Aggravated speeding is a criminal misdemeanor, so a lawyer is strongly recommended. An attorney can often secure supervision or a reduction that keeps a conviction off your record, outcomes that are much harder to reach on your own.
Sometimes. Depending on the facts and your record, the prosecutor may agree to amend the charge to a petty speeding offense, which is not a criminal charge.
