DUI Defense Case Study – Hawthorn Woods, Lake County, Illinois
The case summary below relates to a DUI arrest that occurred in Hawthorn Woods, Illinois. The case was assigned to the Waukegan Courthouse, more formally known as the 19th Judicial Circuit Court. This particular courthouse hears misdemeanor and felony cases that originate throughout Lake County, Illinois.
Allegations against our Client: Our 43-year-old client had previously been arrested twice for DUI. As a result, when he was arrested for DUI on this occasion, he was charged with a Class 2 felony, which carries a potential sentence of 3-7 years in the Illinois Department of Corrections.
Our client was stopped by the Hawthorn Woods Police Department after he was allegedly observed driving into oncoming traffic. Our client agreed to take standardized field sobriety tests, which in the opinion of the arresting officer he failed. Our client was subsequently arrested for DUI and refused to submit to a breath test. Our client was polite and respectful with the police officer throughout the investigation.
Outcome: We requested that the case be set for trial and, after extensive negotiations with the Lake County State’s Attorney’s Office, we were able to secure an amendment of the felony DUI charge to misdemeanor Reckless Driving. Many factors, including various mitigating circumstances, were taken into account during the negotiations.
As a result of reduction of the offense, our client was able to avoid a felony conviction and any jail or prison time. Furthermore, the amendment of the charge to Reckless Driving prevented the revocation of his driver’s license by the Illinois Secretary of State. A conviction for DUI would have caused the indefinite loss of his driving privileges.
